What Is a Hague Apostille?

A Hague apostille is a certificate issued under the Hague Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents. It confirms three things about a public document: the authenticity of the signature on it, the capacity in which the person signing acted, and, where relevant, the identity of the seal or stamp on it.

Before the Convention, a document had to pass through a long legalization chain: local authority, foreign ministry, the embassy of the destination country and sometimes that country's foreign ministry. The Hague apostille replaces this chain with one certificate from one designated authority in the country where the document was issued. Every other member country must then accept that apostille without further legalization.

An apostille does not confirm the content of a document. It does not prove that a degree is equivalent to a foreign degree, that the figures in an invoice are correct, or that a marriage meets another country's legal conditions. It only confirms that the signature and seal on the document are genuine. This is why some countries also ask for translation, credential evaluation or registration after the apostille.

History of the Hague Convention Apostille

The Hague Convention Apostille was drafted by the Hague Conference on Private International Law (HCCH), an intergovernmental organisation based in The Hague, the Netherlands. It was concluded on 5 October 1961 and entered into force on 24 January 1965. Its aim was simple: to make it easier for public documents to move between countries by removing the slow and costly process of diplomatic and consular legalization.

Over six decades, the Convention has become one of the most widely used international treaties in the world. Millions of apostilles are issued every year for study, work, marriage, adoption, immigration, trade and court cases. Membership has grown steadily, with many new members joining in recent years, including China in 2023, Canada in 2024 and Bangladesh in 2025.

The HCCH also runs the electronic Apostille Programme (e-APP), which encourages member countries to issue electronic apostilles and keep online registers, so that apostilles can be verified quickly and securely.

How the Hague Convention Apostille Works

The Convention is short, but a few of its rules explain everything about how the apostille works.

Which Documents Are Covered (Article 1)

The Convention applies to public documents executed in one member country that are to be produced in another. These include:

  • Documents from courts or court officials, including documents from a public prosecutor, a court clerk or a process server
  • Administrative documents, such as birth, marriage and death certificates issued by registrars
  • Notarial acts, such as notarised affidavits and powers of attorney
  • Official certificates placed on private documents, such as an official certificate recording the registration of a document or verifying a signature

The Convention does not apply to documents executed by diplomatic or consular agents, or to administrative documents dealing directly with commercial or customs operations. In practice, private commercial documents are first verified by an authority such as a notary or a Chamber of Commerce, which turns them into documents that can be apostilled.

One Formality Only (Article 3)

The apostille is the only formality a member country may require to certify the signature, capacity and seal on a public document from another member country. Embassies and foreign ministries of member countries therefore do not legalize documents from other member countries.

Standard Format (Article 4)

Every apostille follows a model with a fixed heading in French, "Apostille (Convention de La Haye du 5 octobre 1961)", and ten numbered fields. This standard format allows an official anywhere in the world to read an apostille, whatever its language.

Competent Authority (Article 6)

Each member country designates one or more competent authorities to issue apostilles. In India, the competent authority is the Ministry of External Affairs.

Register and Verification (Article 7)

Each competent authority must keep a register of the apostilles it issues, recording the number, date and signatory. This allows any receiving authority to check whether an apostille is genuine.

Hague Apostille India: India's Membership of the Convention

India acceded to the Hague Apostille Convention on 26 October 2004, and the Convention entered into force for India on 14 July 2005. Since then, Indian public documents can be apostilled for use in other member countries, and apostilles from other member countries are accepted in India. When India joined, five countries raised objections under Article 12: Belgium, Finland, Germany, the Netherlands and Spain. An objection means the Convention does not apply between those two countries. Belgium, Spain, the Netherlands and Finland later withdrew their objections, in 2008 and 2009, so the apostille now works between India and those countries. Germany has not withdrawn its objection, so the Hague apostille does not apply between India and Germany. We explain what this means for Germany-bound documents further down this page.

Government of India Apostille: Role of the MEA

No state government, notary, university, embassy or private agency can issue an apostille on its own. Countries Where the Hague Apostille Does Not Work for

Germany: Objection to India's Accession

Germany is a member of the Convention, but it objected to India's accession in 2005 and has not withdrawn that objection. According to the German Missions in India, the Convention is therefore not applicable between Germany and India, so German authorities do not accept an Indian apostille as legalization.

How Germany Checks Indian Documents

German missions in India stopped the legalisation procedure in 2000. Instead, when a German authority or court needs to check an Indian document, the German mission can carry out a document verification through administrative assistance, using service providers who check the document with the issuing authority. The fee for this verification is charged per application and is set by the German missions. Many German universities and offices also work with officially certified copies or their own verification processes. Always follow the exact instructions of the German authority asking for your document.

Non-Member Countries

Countries that are not members of the Convention do not accept an apostille. Documents for these countries need embassy attestation: verification in India, MEA attestation, the destination embassy's attestation and often that country's foreign ministry (MOFA) attestation. Common examples for Indian clients include the UAE, Qatar, Kuwait, Iraq, Iran, Jordan, Lebanon, Egypt, Thailand, Vietnam, Malaysia, Nepal, Afghanistan, Ethiopia and Nigeria.

Objections Between Other Countries

Objections also exist between some other pairs of countries. For example, some European states objected to the accession of certain newer members. These objections do not affect Indian documents unless India is one of the two countries involved, but they show why checking the current status is important.

Universities in France, Italy, Spain, Poland, the Netherlands, Ireland and other member countries often ask for an apostilled degree, transcripts and 12th marksheet. Some also need a certified translation. Start early, because state HRD verification can take time.

Work Permits and Skilled Migration

Employers and immigration authorities in Canada, Australia, New Zealand, the UK, the USA and Europe may ask for an apostilled degree, experience letters, PCC and birth certificate. Professional licences, such as nursing or engineering registration, usually need apostilled academic documents and council registrations.

Marriage, Spouse Visas and Family Reunion

Couples registering a marriage abroad or applying for a spouse visa usually need an apostilled marriage certificate, birth certificates and sometimes a single status certificate. Families moving together often need children's birth certificates and school documents apostilled as well.

United States and United Kingdom

Using a Foreign Hague Apostille in India

The Convention works both ways. A public document issued in another member country, such as a foreign birth certificate, degree or company document, can be used in India with an apostille from that country's competent authority, as long as the Convention applies between India and that country. In that case, Indian authorities do not need Indian embassy or consulate legalization. Some Indian offices may still ask for an English translation of documents in other languages.
